1. Scope and consumer rights
These terms apply to Central Bearded Dragons sold directly by Fusion Bearded Dragons (“Fusion”) to a buyer. The individual listing or written offer identifies the dragon, price, stated genetics and collection or freight arrangements.
Nothing in these terms excludes, restricts or modifies any non-excludable right or remedy, including rights under the Australian Consumer Law. Those rights apply independently of Fusion's voluntary guarantees in sections 9 and 10, which have their own stated conditions.
2. Descriptions, genetics, sex and photographs
Fusion describes an animal as accurately as reasonably possible, including known visible defects and genetic details relevant to the sale. A possible or unproven trait is not guaranteed unless expressly confirmed for that dragon.
Photographs show the actual dragon unless clearly stated otherwise. Its apparent colour may vary with lighting, camera, screen, shedding, temperature and age; no future colour intensity is promised unless expressly stated.
Stated sex is Fusion's best assessment at the time of sale. Sexing a young dragon can be uncertain, and accuracy cannot always be guaranteed. If Fusion later finds that its assessment was incorrect, contact us so we can discuss the circumstances and available options.
Parent photographs are Fusion's proprietary material and are not shared. Genetic lineage is provided for Fusion-bred dragons purchased by private buyers for their own collection. The wholesale exception is in clause 13.2.
3. Waiting list
Joining the baby waiting list is a free expression of interest. It does not reserve a dragon or guarantee a particular animal, sex, colour, genetics, price or release date.
Fusion may contact a person on the list when a suitable dragon becomes available. An offer remains subject to the licence and purchase requirements below. If the person cannot proceed because the required licence is not held, Fusion may offer the dragon to someone else and the person must rejoin the list for later consideration.
4. Licences, permits and destinations
The buyer must be located in Australia and, where required, hold the wildlife licence or authorisation needed to acquire and keep the dragon in the Australian state or territory where it will live. The required licence or authorisation must be held when a dragon is offered and before purchase. Fusion may request proof with the purchase form. A licence is not needed merely to enquire or join the waiting list.
An interstate buyer is responsible for checking and obtaining any destination import permit required. Fusion arranges a Victorian export permit where required; the buyer is not required to upload a copy of the import permit to Fusion.
Australian law prohibits the commercial export of live native reptiles, so Fusion sells dragons only within Australia and does not export internationally. Tasmania and Western Australia have restrictions on importing and keeping reptiles; Fusion does not sell or freight dragons to either state.
5. Choosing, payment and holding
The buyer chooses from dragons listed on Fusion's website or official Facebook page, or accepts an individual offer from Fusion. Fusion may decline to proceed when legal requirements or suitable care cannot be met or the dragon's welfare would be at risk, subject to applicable law.
After choosing or being offered a dragon, the buyer completes Fusion's online purchase form and acknowledges the version of these terms and Fusion's Care Sheet or Care Guide supplied for that purchase. Fusion reviews the details before requesting payment and records both versions accepted. Later updates apply to future sales and do not silently change an earlier purchase.
Fusion does not take deposits or offer payment plans. An enquiry, discussion, waiting-list entry or form submission does not reserve a dragon. Full payment, received and confirmed by Fusion, secures the offered animal.
Buyer cancellation. If the buyer cancels for a change of mind after Fusion has accepted the completed purchase form and received full payment, a care and holding charge of $20 per week applies from the date both of those steps were completed until Fusion receives the cancellation. The charge covers the individual housing, feeding and care provided while the dragon was held for that buyer. Partial weeks are calculated proportionately. Fusion will deduct the charge from the purchase payment and refund the balance. This charge does not apply when the buyer is exercising a right to a remedy under Australian Consumer Law.
Delayed collection. If the buyer cannot collect the dragon or proceed with its agreed freight date when the dragon is ready, Fusion will hold it for one week without a holding charge from the agreed collection or dispatch date. After that week, a charge of $20 per week, calculated proportionately for partial weeks, applies until the dragon is collected or dispatched. This covers its continued individual housing, feeding and care. The charge does not apply to a delay caused by Fusion, the dragon not being ready, or the absence of a suitable flight.
Charges under clauses 5.4 and 5.5 are not added together for the same period. Fusion will tell the buyer what is owing or being deducted before finalising a cancellation or delayed collection.
6. Release readiness and enclosure
Fusion does not release a baby before eight weeks of age. The animal must also be feeding, developing and individually ready for transfer. A baby paid for earlier stays with Fusion until ready.
The buyer is responsible for a suitable individual enclosure with heating, UVB, temperature control and other equipment required by the Fusion Care Sheet or approved replacement Care Guide. Fusion may ask questions or request photographs where it has a concern about the setup; photos are not automatically required from every buyer.
The buyer must have the setup ready and checked before the animal arrives. The specific care conditions for Fusion's additional health guarantee are in section 10.
If Fusion cannot supply the dragon. If, after payment but before handover, the chosen dragon dies, becomes unfit for transfer or otherwise cannot be supplied, Fusion will tell the buyer promptly. The buyer can receive a full refund of the amounts paid for that dragon, including any freight already paid, or agree to take a suitable replacement if one is available. No cancellation or holding charge applies.
7. Pickup from Fusion
Pickup is by appointment from Hoppers Crossing, Victoria. The buyer should bring a secure, appropriately ventilated and temperature-suitable container for the trip home.
The buyer or authorised collector should inspect the dragon at handover and raise an immediate concern promptly. Routine care and safe transport after handover are the buyer's responsibility, subject to applicable consumer rights.
8. Airport freight and collection
Fusion arranges airport-to-airport freight through Tail Travel to eligible Australian airports serviced by Qantas, Virgin Australia or an affiliated carrier, where live animal freight is accepted. Not all airports can accept live animal freight. Fusion will confirm the availability of freight to the buyer's nominated airport when the order is placed. Freight is normally arranged for Friday if a suitable flight is available; another day may be needed.
The buyer supplies accurate contact, recipient and destination details. Tail Travel sends transport instructions by email. The buyer must check the inbox, including junk or spam, and arrange for themselves or a nominated person to attend the specified collection location unless delivery to the residence is arranged under clause 8.3. Flight schedules can change.
If the buyer cannot collect from the airport, Tail Travel can, in most circumstances and subject to availability, arrange for one of its agents to collect the dragon and deliver it to the buyer's residence. This is an optional service with an additional charge set by Tail Travel or its agent, outside Fusion's control. Tail Travel will confirm the availability and charge before the buyer agrees to the service.
If collecting from the airport, the buyer or authorised collector must collect the dragon within 60 minutes of the collection time stated in Tail Travel's email and inspect it immediately. If delivery to the residence under clause 8.3 is arranged, the buyer must inspect the dragon as soon as the agent delivers it.
9. Additional live arrival guarantee
For airport collection by the buyer or their authorised collector, if the dragon arrives deceased or with an obvious serious transport-related condition, the buyer must notify Fusion immediately using the contact in section 14.3. Send clear photographs of the box and dragon promptly after collection, while the dragon remains in its original container, and retain the container and other relevant evidence.
For an accepted claim under this additional live arrival guarantee, Fusion provides a replacement dragon if available or a full refund including freight. Replacement is subject to suitability, legal requirements and safe transport.
Fusion's additional live arrival guarantee in clauses 9.1 and 9.2 does not apply if the buyer chooses the optional agent collection and home delivery service under clause 8.3. Fusion cannot verify how an agent has handled or transported the dragon between the airport and the residence. This exclusion affects only the additional live arrival guarantee; it does not remove any rights the buyer has under Australian Consumer Law, including where a delivery arranged through Fusion causes a problem.
If an agent delivers the dragon to the residence, the buyer must inspect it on delivery and promptly send Fusion clear photographs or video of the dragon by Facebook Messenger or text message to 0433 046 156 so Fusion can confirm its condition. If the dragon appears unwell or injured, the buyer must tell Fusion immediately. If Fusion confirms that the dragon was healthy on delivery, the additional health guarantee in section 10 applies, subject to its conditions. Its three-month period is counted from the date of delivery, not from the date Fusion reviews the photographs or video.
10. Additional three-month health guarantee
Fusion offers the original buyer of a dragon purchased directly from Fusion a voluntary three-month health guarantee as a goodwill gesture. We offer it because we are confident in the care we provide and the guidance in our Care Guide. It begins on the date the buyer receives the dragon. It is Fusion's own additional promise, with the conditions below, and is separate from any rights the buyer may have under Australian Consumer Law.
The buyer is responsible for following the version of Fusion's Care Sheet or Care Guide recorded with their purchase throughout the guarantee period. Eligibility for this voluntary guarantee depends on doing so. This includes the minimum individual enclosure, heating, UVB, temperature gradient, feeding and care requirements. Fusion's stated exclusions include coil UVB, glass tanks, 3D backgrounds during the guarantee period and an incorrect gradient. Following advice from another source that leads to care outside Fusion's requirements may affect eligibility for this additional guarantee.
How to raise a health concern. As soon as the buyer notices or suspects that something may be wrong with the dragon, they must contact Fusion immediately using Facebook Messenger or the phone number in clause 14.3. To help Fusion assess the concern, the buyer must provide, when requested, clear photographs or video of the dragon and its enclosure; the current temperatures and how they were measured; the type and age of the lighting and other equipment being used; and any other relevant care information Fusion reasonably requests. Fusion will then discuss the next steps with the buyer, including whether a veterinary assessment is needed. Necessary urgent veterinary care must not be delayed while waiting for Fusion to respond.
Fusion will assess the dragon's condition, history before transfer, the care provided after transfer, exposure to other reptiles and relevant veterinary findings. A health problem during the three months does not automatically establish that the dragon had a problem when supplied. Fusion will honour this voluntary guarantee where the buyer has followed Fusion's care requirements and the available evidence supports a health problem with the dragon rather than a problem caused or materially worsened after transfer by unsuitable care, cohabitation, injury or neglect. Section 1.2 still applies independently.
If Fusion accepts a claim under this voluntary guarantee, Fusion will offer a suitable replacement dragon if one is available or a refund of the dragon's purchase price.
11. Care, quarantine and veterinary attention
After handover the buyer is responsible for day-to-day housing, feeding, handling, supervision and veterinary care. Fusion recommends quarantining every new dragon from other reptiles and using separate equipment during quarantine.
Obtain assessment from a reptile-experienced veterinarian when needed. Do not delay emergency treatment while waiting for Fusion to respond. The additional guarantee in section 10 does not cover illness introduced by exposure to other reptiles after transfer.
12. Refunds, change of mind and transfer
A buyer who cancels for a change of mind after purchase is subject to the care and holding charge and balance-refund process in clause 5.4. The live arrival and health promises in sections 9 and 10 are additional to the independent consumer rights described in section 1.2.
Fusion's additional three-month guarantee and direct customer support apply to the original direct buyer only. The guarantee does not transfer if the dragon is resold, traded, gifted or rehomed.
Fusion's additional direct-sale guarantee does not apply to a dragon purchased through a retailer. The buyer deals with that retailer about its sale, after-sales care and consumer obligations. Public Fusion care material remains accessible.
Live animals and biosecurity. Fusion does not accept a live dragon back after handover under our voluntary returns or health-guarantee policies. We cannot verify whether it has been exposed to disease or whether quarantine and care were carried out correctly. Bringing it back could put our other animals at risk. Fusion can assess a health claim using photographs, video, care information and veterinary findings, and can provide an accepted replacement or refund without taking the live animal back. This policy does not remove any right the buyer has under Australian Consumer Law. If the law requires a physical return in a particular case, Fusion will arrange a biosecure process away from our breeding collection.
13. Wholesale sales, images and events outside control
Fusion may use photographs and videos it takes of its dragons for marketing, education and promotion. Fusion's own photographs, videos, care text, diagrams and branding remain its material. Fusion will not publish customer personal details without permission unless disclosure is authorised or required by law.
Wholesale sales. Fusion does not provide genetic lineage or parentage details for dragons sold wholesale to authorised pet stores or other buyers purchasing for resale. This applies to any wholesale dragon, whether one or several are purchased. A private buyer purchasing dragons for their own collection is not treated as a wholesale buyer merely because they purchase more than one. Any genetics expressly stated for an individual dragon in its listing or written offer remain part of that description.
Airline or courier disruption, extreme weather, natural disaster, government restrictions or similar events may change an agreed collection or freight date. Fusion will take reasonable steps to communicate and arrange a suitable next option, subject to section 1.2.
14. Governing law and claim contact
These terms are governed by the laws applicable in Victoria, Australia. Section 1.2 applies throughout.
